What it does
This bill stops states from taking children from parents based on gender views. It stops states from blocking foster or adoption based on gender views. It says parental choices about gender are not abuse under federal law. States that get federal child-welfare money must follow this rule. Parents can sue states and child-welfare offices in federal court for money. They can sue if they believe the state acted against them because of gender or sex views.
Who it affects
The bill affects parents, guardians, and children in state care. It affects child-welfare offices in each state and foster parents. It changes how states look into cases when gender comes up.
One thing to notice
The bill makes it hard for states to prove they removed a child for other reasons. If a case file mentions gender, the state must use a high level of proof. This may make child-welfare workers slow to look into cases where gender comes up. They may hesitate even if a child is in real danger.
